Joint project with the State Chancellery of Latvia

Meeting with the participation of the Director of the State Chancellery of Latvia Martins Krievins as well as representatives of the Latvian state agencies and experts was held at the Administration of the Government today.
Project on "Human Capital Development for the Public Administration and Effective Governance in Georgia and Ukraine" is implemented with the financial support of the Minister of Foreign Affairs of Latvia. Within the frames of the respective project, experts of Latvian State Chancellery will share their expertise and best practice with their Georgian counterparts. Areas that will be covered by the experts include public administration reforms and management of human resources in civil service, development of the system of competencies, salaries of civil servants, professional development, education and activities. Particular attention will be paid to elaboration, coordination and implementation of policies in the public sector. 
Additional consultations concerning the reform of the public service will be held with the participation of experts of the State Chancellery of Latvia.
Meeting at the Administration of the Government of Georgia was attended by the Head of the Administration of the Government of Georgia Maia Tskitishvili, Head of the Civil Service Bureau Ekaterine Kardava and representatives of the public agencies.

  • The sitting of the Procedural Issues and Rules Committee

    The Committee discussed enactment of the law on Public Service. According to the Head of Public Service Bureau, Ekaterine Kardava, since enactment was postponed to July 1, the Bureau actively works on by-laws. “Our obligation was to adopt 13 by-laws. 11 of them are already adopted. We have the by-law regulating teaching under development and related by-laws on academic leave and certification to be submitted to the Government in 2 weeks”.
    She spoke about each acts and stated that the draft on salaries is developed by the Ministry of Finance. As the Chair, Giorgi Kakhiani noted, it is the first time when we adopt the law on salaries regulating the salaries of politicians and public servants.
    The Committee considered with the I reading the draft by Giorgi Kakhani and Guram Macharashvili on Rules of Procedure, envisaging specification of consideration of the legislative drafts, definition of new regulations in view of realization of the right of submission of the draft and consideration. The draft specifies substantiation of the draft by the author to provide the reason and essence of the changes. The draft defines the rule of submission – the draft shall be submitted addressed to the Parliamentary Bureau. The draft also specifies calculation of consideration term when the draft fails to meet the requirements of the paragraphs 2 and 3 of the Article 150 of the Rules of Procedure. The Committee supported the draft.
    The Committee considered registration of the initiative group of the citizens (I. Pavliashvili, M. Kuprava-Sharvashidze, T. Abramishvili, E. Rusetskaya, Ts. Bakuradze) in view of realization of the right of submission of the change to the organic law on Election Code with the initiative of 30000 electors. According to G. Kakhaini, all the documents are submitted and the Committee supported registration of citizens.
    The Committee considered the draft by GYLA on Rules of Procedure, re-formulating Article 219, namely nomination of the candidate of membership of High Council of Justice shall be enclosed other documents and the document on approach of the candidate. The draft envisages the Bureau to deliver the list of the candidates and enclosed documents to the Factions and respective Committees. Novelty is publication of the list and documents on the Parliamentary web-site. The draft defines the rule of consideration of the candidates, including the approval of the Committee, consideration terms, right to attend the Committee sitting and right to deliver the speech.
    According to G. Kakhiani, the Parliament plans to adopt the changes regarding the number of issues. The Committee postponed consideration for the next sitting.

     

     
  • The Committee considered the draft on Insolvency Proceedings

    The Committee considered the draft on Insolvency Proceedings, introduced by the First Deputy-Justice Minister, Alexander Baramidze. The draft envisages enactment of the changes related to regulation of general principles and rules on establishment of e-system of insolvency proceedings on January 1, 2018 instead of 2017.  The additional term is needed for accomplishment of installment of respective technical and computer systems in judicial system.
    The Committee considered the drafts on: Criminal Code; Non-Custody Enforcement Rule; Juvenile Code of Justice introduced by the Parliamentary Secretary of the Government, Shalva Tadumadze with simplified consideration. The draft envisages postponement of application of detention – detention shall apply on January 1, 2018 instead of 2017. For the first time the only Detention Department was built in 2013 now in pilot mood purposed for 100 convicts. The changes enable dislocation of the convicts with lighter detention altered by the Ministry of Correction for unserved term.
    The draft on Civil Security, postponing enactment of the by-law acts was introduced by the Deputy-Interior Minister, Shalva Khutsishvili. The law on Civil Security was adopted in 2014 unifying the civil defense and fire brigades under the MIA. The draft envisages issue of the number of by-law acts and technical regulations. In order for the authorized parties – the Government and MIA to adopt the by-laws, the term was defined as December 31, 2017 instead of 2016.
    MPs considered with the II reading the drafts on: Interest Incompatibility and Corruption in Public Service; Notary; Tax Code, introduced by the Head of Public Service Bureau, Ekaterine Kardava. The draft specifies the list of the persons subject to application of the ethics and behavior general rules. The draft also corrects the gap mitigating the legal mechanism on publication of information about the property assets of an official. The official, within 2 months upon dismissal, shall fill in the property declaration. The draft also corrects the technical gap and replaces the term “Nominal” with the term “percentage”.
    The Committee expressed sundry technical remarks. E. Kardava answered the questions and promised reflection of the remarks to the draft. The Committee supported the draft.
    The Committee considered the draft by Dimitri Khundadze and Mirian Tsiklauri on Adoption and Foster Care. The draft regulates relations between the state and the adopter/fosterer, the terms and rule of adoption and foster care, as well as the relations between the origin and recipient states. The draft aims at regulations to facilitate disposal of a child to the stable family.
    As M. Tsiklauri stated, development of the draft took 1 year with involvement of UNICEF and respective NGOs. The draft entailed discussion concerning specification of the list of the persons with restricted rights of adoption. Consideration will continue at the next Committee sitting attended by UNICEF representatives.
